US Court Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her decision, the court pointed out that the government lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
